These terms govern your use of the Mercato marketplace, whether you are shopping for made-to-order goods or selling them. Please read them carefully.
By accessing or using mercato.homes you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the marketplace.
You must be at least 13 years old to use Mercato. If you use the platform on behalf of a business, you confirm you are authorised to bind that business to these terms.
You are responsible for the accuracy of the information on your account and for keeping your password confidential. You are responsible for activity that happens under your account.
Do not share your account, impersonate someone else, or create accounts for abusive purposes.
Mercato is a marketplace: products are listed and fulfilled by independent sellers, not by us. When you place an order you enter into a contract with the seller of that product.
Product descriptions, prices, images and stock are provided by sellers. We aim for accuracy but cannot guarantee that every listing is complete or error-free. If a listing contains an obvious error, the seller may cancel and refund the order.
Made-to-order and personalised items are produced specifically for you. Return and cancellation rights for these items are limited and are described in the seller's policy summary shown on the product page.
Cross-border orders may be subject to import duties or taxes set by your local customs authority. Unless stated otherwise on the listing, these are the buyer's responsibility.
Sellers must provide accurate information about themselves and their products, keep listings and stock up to date, and fulfil orders promptly and as described.
Sellers must comply with all laws that apply to their products, including safety, labelling, and export and import requirements.
Sellers are responsible for the content of their listings, including any text, images and claims, and for honouring the return policy they publish.
Payments are processed by Stripe. By buying or selling you also agree to Stripe's terms in addition to these terms.
Mercato charges a transaction fee on completed sales, which is set out on the pricing page and deducted from the seller's payout. Opening a store is free and there are no listing fees.
Sellers are responsible for the taxes that apply to their own sales and for their own tax reporting.
You may not list, sell or buy items that are illegal, counterfeit, stolen, unsafe, or that infringe someone else's rights. This includes weapons, illegal drugs, and products that violate export or import controls.
You may not use Mercato to spam, scrape, transmit malware, attempt to bypass our security, or interfere with other users' use of the marketplace.
We may remove listings, restrict features, or suspend accounts that break these rules.
Mercato's name, logo, and the software and design of the platform belong to us or our licensors. You may not copy or reuse them without permission.
You keep ownership of the content you upload, such as product photos and text, and you give us a licence to host, display and promote it on the platform so that we can operate the marketplace.
Mercato is provided "as is" and "as available". To the extent permitted by law, we do not make warranties about the marketplace, and we do not guarantee that listings are accurate, that sellers will perform, or that the service will be uninterrupted or error-free.
To the extent permitted by law, Mercato is not liable for indirect, incidental or consequential losses, or for lost profits or data, arising from your use of the marketplace. Where liability cannot be excluded, our liability is limited to the amount of transaction fees we received on the transaction giving rise to the claim.
Nothing in these terms limits any right you have that cannot be limited by law, such as rights under applicable consumer protection rules.
You may stop using Mercato at any time. We may suspend or terminate access if you breach these terms, if we are required to by law, or if continuing would expose us or other users to risk.
These terms are governed by the laws of the province of Ontario, Canada, without regard to conflict-of-law rules. Disputes will be handled by the courts of that province, unless the law that applies to you requires otherwise.
Before starting formal proceedings, please contact us so we can try to resolve the issue informally.
We may update these terms from time to time. When we do, we will revise the date at the top of this page. Continuing to use Mercato after a change means you accept the updated terms.
